What is the order of the courts from highest to lowest?

Courts of law:

  1. Constitutional court – consists of 11 judges
  2. Supreme court of Appeal (SCA) – employs between three and five judges – situated in Bloemfontein
  3. High court (HC) – Provincial
  4. Special courts – (Labour courts, labour appeal courts, CCMA, Tax court, Central Divorce court, Land court, Water court, Consumer court, Equality court)
  5. Magistrates court – lowest court.
    Criminal courts Civil courts
    • Regional courts:
    – All offences including treason and rape
    – Sentences up to 15 years
    – Or fines up to R300 000
    • District courts:
    – All offences (excluding treason and rape)
    – Sentences up to 3 years
    – Or fines up to R60 000
    • District Magistrates Courts deals with claims up to R100 000
    • Regional Magistrates Courts deal with the following:
    – Motor vehicle accidents between R100 000 and R300 000
    – Credit Agreements disputes between R100 000 and R300 000
    – Matters involving immovable and movable property
    – Family matters such as divorces etc
    • Small claims Courts – deals with claims up to R12 000

The order leaves out the Special Court.
